Labor certification is a process that U.S. employers must go through in order to hire foreign workers on a permanent basis through the Employment-Based Immigration process. It involves obtaining approval from the U.S. Department of Labor (DOL) that the employer has made a good faith effort to recruit U.S. workers for the position and that there are no qualified U.S. workers available to fill the position.

The employer must demonstrate that hiring a foreign worker will not adversely affect the wages and working conditions of U.S. workers similarly employed in the area of intended employment.
